These Terms and Conditions ("Terms") govern your use of SWEATX, a fitness coaching platform operated by narmiAI FZ-LLC ("we," "us," or "our"). By accessing or using SWEATX, you agree to be bound by these Terms and enter into a legal agreement with narmiAI FZ-LLC.

1. Service Description

SWEATX is a comprehensive fitness coaching platform that enables certified coaches to manage athletes remotely through:

• Block-based workout creation: Reusable workout components
• Dynamic scheduling: Real-time workout assignment and tracking
• Cross-platform synchronization: Web dashboard and mobile applications
• Performance monitoring: Workout completion, pain reporting, and progress tracking
• Third-party integrations: WHOOP fitness data and other wearable devices

2. User Accounts

2.1 Eligibility

• Coaches: Must be certified fitness professionals or have relevant expertise
• Athletes: Must be 13 years or older (or have parental consent if under 18)
• Account Creation: You must provide accurate, current information
• Account Security: You are responsible for maintaining password confidentiality

2.2 Account Types

• Coach Accounts: Access to athlete management, workout creation, and analytics
• Athlete Accounts: Access to assigned workouts and personal progress tracking

2.3 Access Codes

Athletes join coach-managed groups through unique access codes provided by their coach.

3. Subscription Plans and Payment

• Payment Processor: Stripe (handles all payment processing securely)
• Billing: Automatic monthly or annual billing through Stripe
• Currency: USD
• Taxes: Additional taxes may apply based on your location
• Refunds: Contact us at help@sweatx.app for refund requests
• Cancellation: Cancel anytime; service continues until period end. No refunds for partial periods.
• Payment Data: Payment information is processed by Stripe. We do not store full payment card details.
• Price Changes: We reserve the right to modify subscription prices with 30 days' notice to existing subscribers.

4. User Obligations and Conduct

4.1 General Obligations

• Accurate Information: Provide truthful information about fitness levels and medical conditions
• Safe Usage: Use equipment properly and consult healthcare providers before starting programs
• Respectful Conduct: No harassment, discrimination, or inappropriate content

4.2 Coach Responsibilities

• Professional Standards: Maintain appropriate certifications and insurance
• Athlete Safety: Consider individual capabilities, injuries, and health conditions
• Data Privacy: Protect athlete personal information
• Content Quality: Create safe, effective workout programs

4.3 Athlete Responsibilities

• Medical Disclosure: Report injuries, medical conditions, and medications
• Program Compliance: Follow workout instructions carefully
• Progress Reporting: Accurately report completion and pain levels
• Equipment Safety: Use appropriate equipment and techniques

5. Intellectual Property

5.1 Our Content

• Platform: SWEATX software, design, and branding are our property
• Exercise Library: Video content and exercise instructions are licensed
• Trademarks: "SWEATX" and related marks are our trademarks

5.2 User Content

• Workout Plans: Coaches retain ownership of created workout content
• License Grant: You grant us license to display and process your content
• User-Generated Content: Must not infringe third-party rights

5.3 Third-Party Content

Exercise videos and content from third-party providers are subject to their licenses.

6. Data and Privacy

6.1 Data Collection

We collect personal and fitness data as described in our Privacy Policy.

6.2 Data Ownership

• Your Data: You own your personal and fitness data
• Coach Data: Coaches own workout plans and athlete performance data
• Platform Data: We own aggregated analytics and usage statistics

6.3 Data Portability

You may export your data in accordance with our Privacy Policy.

7. Third-Party Integrations

7.1 WHOOP Integration

• Optional Service: WHOOP integration is completely voluntary and can be enabled or disabled at any time
• Data Sharing: When you connect your WHOOP account, fitness data is shared with WHOOP's API for integration purposes
• Account Linking: You maintain full control over the connection between your SWEATX and WHOOP accounts
• Data Usage: We use WHOOP data solely to display your recovery and sleep metrics within SWEATX

7.2 Other Integrations

• Payment Processing: Stripe handles all subscription and payment processing
• Analytics Services: Google Analytics and Vercel Analytics track usage
• Email Services: Resend delivers transactional emails
• Storage Services: Firebase stores exercise videos

8. Disclaimers

8.1 Fitness Disclaimer

• Not Medical Advice: SWEATX is not a substitute for professional medical care
• Individual Assessment: Consult healthcare providers before starting programs
• Injury Risk: Physical activity carries inherent risks
• Results Not Guaranteed: Individual results may vary

8.2 Technical Disclaimers

• Service Availability: We strive for 99.9% uptime but cannot guarantee uninterrupted service
• Data Accuracy: We take care to ensure accuracy but cannot guarantee all data is error-free
• Third-Party Services: We are not responsible for third-party service interruptions

9. Limitation of Liability

9.1 General Limitation

To the maximum extent permitted by law, our total liability for any claims arising from your use of SWEATX is limited to the amount you paid us in the 12 months preceding the claim.

9.2 Excluded Damages

We are not liable for indirect, incidental, consequential, or punitive damages, including:

• Personal injury or property damage
• Lost profits or business interruption
• Data loss or corruption
• Third-party claims

9.3 Coach Liability

Coaches using SWEATX are independent professionals responsible for their own liability insurance and professional standards.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

• Your violation of these Terms
• Your use of SWEATX
• Your violation of applicable laws
• Third-party claims related to your content or conduct

11. Termination

11.1 Termination by You

You may terminate your account at any time through the app settings.

11.2 Termination by Us

We may terminate or suspend your account for violations of these Terms, illegal activity, or at our discretion.

11.3 Effect of Termination

• Access to your account will be disabled
• We may retain your data as required by law
• Outstanding payments remain due
• Sections 5, 8, 9, 10, and 12 survive termination

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles.

12.2 Dispute Resolution

• Informal Resolution: Contact us first to resolve disputes
• Mediation: Required before formal proceedings
• Arbitration: Binding arbitration in Ras Al Khaimah, UAE for disputes over $10,000
• Class Action Waiver: Disputes resolved individually, not as class actions

12.3 Jurisdiction

You consent to exclusive jurisdiction in Ras Al Khaimah courts for disputes not subject to arbitration.

13. Changes to Terms

We may modify these Terms at any time. Changes will be effective when posted. Continued use after changes constitutes acceptance.

14. Severability

If any provision is found invalid, the remaining provisions remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.
